Terms and Conditions

ECO MIGRATIONS: Tour company.

GUEST(S): Direct passenger(s) or travel agency(s).

Rates

The Tour Company publishes its trip prices as per person, based on double occupancy, unless otherwise indicated. All prices are shown in US Dollars, the total price is in Mexican pesos. All prices are subject to change without notice. The Tour Company’s most recent pricing can be found on its website.

Single travelers

A single supplement, equivalent to 20% of the total trip cost, applies to all trips. Our booking is set to a 2 person minimum, so, at checkout, please enter the following code: SOLOTRAVELROCKS! to obtain your final price, including the single supplement.

Discount Policy for Children

We grant a 25% discount off the net price for children who have not yet turned 12 years of age at the date of the trip and a maximum of two discounts per family. Dates of birth are required during the booking process, and if in doubt, the Tour Company may request a passport or other proof of age. Does not apply on Paddleboard tours.

Gratuities

Gratuities to recognize excellent service are a personal choice and are entirely at the discretion of the Guest. Typical rates in Mexico vary between 10-20%.

Right to use images

Eco Migrations reserves the right to take photographs during the operation of any of its programs and to use them for promotional purposes. We attempt to be discrete, but some pictures are just so great we want to share them. By booking a program with Eco Migrations, travelers agree to allow their images to be used in such photographs. Travelers who prefer that their images not be used are asked to identify themselves to Eco Migrations to be exempted from this clause.

Inability to Perform/ Force Majeur

Eco Migrations reserves the right to modify or cancel a Trip, before or after its start date, because of an Act of God or other political, social, health, environmental or other condition beyond its control (force majeure). Force majeure events include, but are not limited to, severe weather conditions, war or terrorism, civil unrest, economic collapse, governmental or other authorities’ restrictions on travel or other activities, fire or other natural disasters, health threats, including disease outbreaks or pandemics, or, a future spike in COVID-19 cases, answering a distress call or any action necessary to save or preserve life at sea, technical problems. Typically, these events are unexpected and unforeseeable and may compromise the health or well-being of participants, crew or our vessels, or otherwise prevent us from performing our trips safely. 

If Eco Migrations determines, at its sole discretion, that it must cancel a Trip due to a force majeure event, Eco Migrations may suspend or terminate its performance. In this case, the cancellation policy does not apply and no refunds or substitutions will be granted except at Eco Migrations’ sole discretion. In the event of a force majeure, you agree that Eco Migrations will not be found in breach of these Terms, and/or legally liable for any losses, costs or damages to you. 

In any case, if Eco Migrations alters or cancels a Trip, Eco Migrations is not responsible for any indirect, consequential, incidental or other costs/damages you may incur, including but not limited to non-refundable airline tickets or change fees, equipment purchased for the program, visas and vaccinations. 

Day Trips

  • Bookings can be done online or at the shop. Cash and Credit Card will be accepted for final payments. Full payment is required before travel. 
  • Prices on the website are displayed in USD approximately. Payment is done in MXN.

 

Modification and Cancellation Policy

Modification and cancellation requests should be made via email to info@ecomigrations.com.

The following charges will apply if should it be necessary to modify or cancel a trip: 

  • Cancellations done more than 48 hours before departure will receive a 100% refund.
  • For modifications done more than 48 hours before departure, the total amount paid may be used for another trip during the year following the original departure date according to Eco Migrations’ availability. A $25.00 re-booking fee per traveler will apply
  • Modifications or cancellations done less than 48 hours before the departure date will be charged 100% without an option to reschedule the trip.
  • Failure to appear at the designated departure time will be considered a no show. We run on a schedule due to the many moving parts of our trips, so we cannot delay an outing due to tardiness. We will wait 20 minutes before being forced to cancel the outing for the tardy party. There will be no refund in case of no show. Please arrive punctually.

If we need to cancel a day trip due to unfavorable weather or we do not have the minimum of 4 travelers you will NOT be charged and the fee will be 100% refunded.

How to guard against cancellation fees: Purchase trip cancellation/interruption insurance directly after the reservation is confirmed. This coverage typically reimburses non-refundable tour costs should the need to cancel arise.

Camping Trip

Modification and Cancellation Policy

Modification and cancellation requests should be made via email to info@ecomigrations.com.

We plan each departure far in advance, and use your payments to prepare the trip and handle other costs associated with operations. Eco Migrations understands how disappointing it can be to cancel or change a long-anticipated adventure, but we must strictly adhere to our cancellation policy. The following charges will apply should it be necessary to modify or cancel a trip:

  • Cancellations done more than 60 days before departure date will receive a full refund minus a 20% administrative fee.
  • Cancellations or modifications done less than 60 and more than 7 days before the departure date will be charged 100% of the cost. The total amount paid may be used for another trip during the year following the original departure date. There will be a $150.00 re-scheduling fee per traveler.
  • Cancellations done less than 7 days before the departure date will be charged 100% without an option to reschedule the trip.
  • In case of last minute situations such as flight delays, contact us and we can arrange to send the boat back to La Paz to pick up the Guests so they can join their ongoing trip. The guest must pay any additional expenses incurred such as food, accommodation, and transportation.

Travel Insurance – Trip Cancellation / Interruption Coverage

Eco Migrations highly recommends that the Guest purchase a travel protection plan that provides coverage for trip cancellation, trip interruption, baggage loss or delay as well as additional coverage such as medical evacuation. Trip cancellation or interruption coverage should cover tour cancellation for reasons of force majeure including but not limited to weather conditions, government actions, war, riots, acts of God and mechanical breakdown, accidental damage or other means of transportation. These policies insure the Guest against paying out-of-pocket for non-refundable expenses of a tour in the form of cancellation fees should the Guest have to either cancel or miss part of a tour due to reasons covered in the policy, which typically include illness, injury and flight delay. Many of these policies include coverage for emergency medical evacuation mentioned above. 

Eco Migrations reminds Guests with pre-existing conditions that trip cancellation / interruption insurance must typically be purchased within 24 hours to 14 days (depending on your insurance) from the time the reservation is confirmed to cover cancellation resulting from a pre-existing condition. For travel insurance to cover your pre-existing condition, you must be medically able to travel on the day you purchase your policy. Guest Obligations

In addition to obeying Eco Migrations’s rules and the rules of the National Parks, the Guest has a responsibility to the Tour Company, its staff and other passengers as well as to Guides and drivers for understanding the conditions explicitly and implicitly communicated in the trip description and itinerary, as well as information communicated by guides and staff members throughout their tour, following normal patterns of social behavior and observing all safety requirements without exception, while acting in an appropriate and respectful manner toward staff members and other guests. The Tour Company reserves the right to cancel the tour of a Guest at any time, without recourse to refund or reimbursement, who acts in a hostile and/or disruptive manner, who flagrantly displays disregard for the welfare of other passengers, staff members and wildlife, or for failing to adhere to the above stated responsibilities. 

Additional responsibilities include responding clearly, precisely and in a timely manner to emails and requests, such as forms to be filled out before your trip; following the instructions of the team en route; and remaining with the group in designated camping areas. Hiking, kayaking and other solo activities are not permitted in some of the areas where we camp and do activities. Please consult your guide.

Risks

Eco Migrations takes all possible measures to ensure you enjoy a safe trip. However, travel entails risks and by booking any of our trips, the guest assumes the risks associated with travel and outdoor activities such as personal accidents, medical emergencies, problems with air travel, etc. Eco Migrations is not responsible in any of these instances.

Release of Liability & Assumption of Risk 

The Guest participating in and/or purchasing a trip from the Tour Company, does so with the full knowledge that an expedition to Mexico, wild Baja and all outdoors areas inherently involves risks and dangers including but not limited to the forces of nature, the unpredictable behavior of wild animals, strikes and/or civil unrest, dangerous roads, trails, travel by vehicles including taxis, buses, airplanes and ocean going vessels, exposure to high and low temperatures, the consumption of alcoholic beverages, physical exertion for which the participant may not be prepared, and or negligence (but not willful or fraudulent conduct) on the part of the Tour Company, or others. During the trip the Guest may be exposed to additional risks and hazards including but not limited to the possibility of accident, injury or illness in a remote area without access to emergency care, rapid evacuation, adequate medical facilities or availability of medical supplies. 

The Guest acknowledges that the enjoyment and excitement derived from an expedition and/or adventure trip comes in part from the inherent risks incurred when traveling, including exposure to the activities offered during a tour such as, but not limited to, swimming, hiking, sea kayaking, snorkeling, navigations and scuba diving, which are all enjoyed with the Guest’s voluntary participation. Fully understanding these risks and that the cost of the Tour Company’s tours are based upon the Guest fully accepting the conditions stated and implied herein, as lawful consideration for being permitted by the Tour Company, to participate on a Tour Company tour and take part in corresponding activities and use of facilities and equipment. 

The Guest agrees to be responsible for their own welfare, and accept any and all risks of delay, unanticipated events, death, illness, injury or emotional trauma and acknowledge that they are voluntarily participating on the tour in full knowledge of these risks and therefore discharge the Tour Company and its owners, agents, contractors, affiliates and employees from and against any and all liability arising from their participation in the tour. The Guest further agrees that this release shall be legally binding upon themselves and all minors under the age of 21 traveling with them, their heirs, successors, assigns, and legal representatives; it being their intention to fully assume all the risk of travel and to release the Tour Company from any and all liabilities to the maximum extent permitted by law.

Acceptance and Knowledge of our Terms and Conditions

The terms and conditions set out below in this document are mandatory and binding. They apply to all reservations and activities made through our website, via email or face-to-face. The use of any of these channels implies the knowledge and acceptance of them.

Updated Versions of this Agreement 

Because the Tour Company may periodically need to update its policies due to changes in the law, the policies of National Parks, or for the benefit of its Guest or the Tour Company, the Terms and Conditions may be updated periodically. The version in effect at the time the Guest ‘indicates acceptance’ will be in governance as will all current laws and National Parks policies.

Medical & Health Requirements / Physical Qualifications

The Guest agrees that he or she is in good health and good physical condition and is physically qualified to participate in the adventure tour or camp chosen. If there is any question as to the physical or health condition of the Guest that may disqualify him/her from participating in the tour he or she should immediately contact Eco Migrations so that both parties may clarify the issue and jointly arrive at a determination of participation.
